2016 Report Overview

In 2016, we were pleased to report that we had no government data data requests and a total of four DMCA complaints, only two of which were honored. In 2016, we began including data on internal policy violations and other matters related to internal policy governance. Please note that this report is updated quarterly and data for the full year may not be available yet.

Data Requests

Ultius will not share or disclose individual user account information unless required to do so by state or federal law and/or under a court order. In cases where we have data requests, we evaluate them on a case-by-case basis and challenge the grounds if appropriate. Our data request report includes information related to how many requests we received and how we responded. To protect the identity of our customers and writers, we only provide statistical data. Please note that in some instances, governments may request data alongside a "gag order" or legal demand that the request is not shared with customers or anyone else. These types of requests are not included in our statistics.

Report Glossary

1. Individual Data Request: We define a data request instance as a formal inquiry from a government agency (or state office) into the activities or account status of a given individual. This includes requests from foreign governments outside of the United States. Requests that are court orders are also included.

2. Total Data Requests: This figure is the total number of resolved requests we received for the given time period. Please note that while we may have received the data request in a previous quarter, our data only reflects its resolution date.

3. Denied Requests: This figure is the total number of requests where the company did not release any user information.

4. Honored Requests: This figure is the total number of requests where the company released user information such as account status, order history, support interactions and other information.

DMCA Copyright Infringement Allegations

From time to time, third parties send us requests to remove content posted on our website on the basis of alleged copyright infringement. In these cases, we follow our standard DMCA policy and address each incident on the merits. Our DMCA copyright infringement report includes the number of alleged requests as well as our response.

5. DMCA Takedown Notice: We define a takedown notice as a formal DMCA related complaint in which a party asked us to take down, or remove a piece of content from our web properties. Multiple requests from the same party are not grouped together. Each page or "instance" reflects an individual data point.

6. Total DMCA Complaints: This figure is the total number of resolved requests we received for the given time period. Please note that while we may have received the takedown request in a previous quarter, our data only reflects its resolution date.

7. Denied Requests: This figure is the total number of requests where the company did not take any action as part of its resolution.

8. Honored Requests: This figure is the total number of requests where the company proceeded to remove content. Content removal does not indicate that the company accepted fault for the alleged infringement; instead, it relfects a good-faith resolution outcome with the party in question.

Internal Policy Violations

Ultius has a number of internal policies to make sure that our platform is being used appropriately. We expect customers to comply with these policies and work hard to enforce them internally through various auditing processes. In some cases where customers allegedly violate our internal policies, we conduct an internal investigation and may respond by terminating the customer relationship. We call this process Customer Relationship Termination (CRT) and share statistical data on how often we do this and under what circumstances.
